This agreement is a contract between Apple Internet and you on matters related to your use of Apple Internet services. In order to use Apple Internet Services, you should fully read and understand this agreement. Restrictions, exclusions or other provisions involving your significant rights and interests (such as penalties for breach of contract, jurisdiction over disputes, etc.) may be highlighted in bold and underlined.
Unless you have fully read, understood and agreed to accept and abide by this agreement, please do not use Apple Internet Services. If you express or imply your acceptance of this agreement through the website or in any other way, or if you use the Apple Internet service in any way, it is deemed that you have read and agreed to be bound by this agreement, and this agreement will have legal effect between you and Apple Internet.
Use of Apple Internet Services shall comply with this Agreement and its service rules. The service rules are subject to the contents displayed on the official website of Apple Internet or other relevant pages. You should know the service rules in advance and operate according to them to ensure smooth use.
Article 1 General
1.1 Apple Internet services refer to various products and services provided by Apple Internet, such as computing and network, cloud server, cloud database, cloud security, monitoring and management, domain name resolution, video services, big data and AI (subject to the actual provision of Apple Internet). You can choose to use one or more specific services according to your needs and abide by their service rules.
1.2 The service terms, rules, descriptions, standards, etc. (collectively referred to as "service rules") involving the service contents, service levels, technical specifications, operation documents, billing standards, etc. of specific services shall be subject to the contents displayed on the official website of Apple Internet or other relevant pages.
1.3 Apple Internet is a neutral technology service provider, providing you with various technical products and services according to the contract; Your website, application, software, platform and any other products, services and related content shall be operated by you and bear all responsibilities.
1.4 Both parties guarantee that they have obtained legal business qualification or government approval in accordance with relevant national regulations, and have the right to operate their products and services in accordance with the law. Both parties further guarantee that they will continue to maintain the business qualification or approval procedures required by relevant national regulations during the validity of this agreement.
Article 2 Account No
2.1 You shall have the necessary and appropriate rights and behavioral capabilities according to law, complete the registration and obtain the Apple Internet service account (hereinafter referred to as "the account") according to the requirements of Apple Internet.
2.2 In order to protect the security and independence of your account and avoid any adverse consequences such as unclear account ownership, you should use your WeChat, QQ, email and WeChat official account to register or log in. Otherwise, you may not be able to log in and use Apple Internet services normally.
2.3 You should fill in and submit authentic, legal and valid materials (collectively referred to as "customer materials") according to the Apple Internet service process, including but not limited to name, contact person, e-mail, contact telephone, contact address, industrial and commercial registration certificate, etc; If the customer information changes, you should timely notify Apple Internet in writing or update it yourself according to Apple Internet's rules.
2.4 The validity of this agreement applies to all accounts under your name. The account will serve as the basis for your identification when using the Apple Internet service. You should take necessary and effective confidentiality and security protection measures for your user name, password and other information (including but not limited to: keeping access rights, setting high-intensity passwords and regular replacement measures). Otherwise, you should bear the consequences. In addition, you shall be responsible for the actions under your account, and all the actions under your account shall be deemed as your implementation, and you shall bear all the legal consequences.
2.5 You need to establish and improve your own internal management system to standardize the use and management of your account. In order to protect your rights and interests, the account should only be used by you. If you authorize your employees or others to manage the account based on your own business needs and other reasons, you must do a good job of authority control, and timely complete the handover and account security protection (such as changing the password, changing the login method, setting account protection, etc.) in case of personnel changes.
2.6 To protect the security of your account and business, you should conduct real name authentication in accordance with relevant national regulations and Apple Internet procedures and systems. You agree to authorize Apple Internet to verify relevant information or materials submitted by you through a third party.
2.7 Real name authentication is the basis for judging the ownership and responsibility of an account. In case of disputes over the ownership of an account, Apple Internet has the right to determine that the account belongs to the real name authentication subject; For accounts with disputed ownership, Apple Internet has the right to temporarily freeze the account. You must be careful when authenticating, pay enough attention and ensure that the authentication subject is consistent with the user of the account, and avoid any improper authentication behavior such as authenticating the account used by the enterprise in the name of an individual or authenticating the account used by me in the name of another person.
2.8 If you find that someone else has stolen your account and password, or any other situation without your legal authorization, you should immediately notify Apple Internet in an effective way and provide necessary information (such as customer information, situation description, certification materials and appeals, etc., so that Apple Internet can verify its identity and events). After receiving your effective notice and verifying your identity, Apple Internet will handle it according to laws, regulations and service rules. You shall bear the relevant responsibilities and consequences arising from Apple Internet's handling according to this article.
If the information you provided is defective, which causes Apple Internet to be unable to verify your identity or judge your needs, which causes Apple Internet to fail to deal with it in a timely manner, you shall bear the losses caused to you. At the same time, you understand that Apple Interconnect needs a reasonable period to process your request. Apple Interconnect does not assume any responsibility for the losses you have incurred before Apple Interconnect took measures and the losses caused by reasons not attributable to Apple Interconnect after taking measures.Article 3 Service
3.1 Service opening
3.1.1 You can purchase the required services online through Apple Internet official website according to your own needs. Before purchasing, you need to carefully read the service rules corresponding to the purchased services and decide whether to purchase or use them according to your own needs. Both parties can also sign a separate agreement according to the actual cooperation needs.
3.1.2 The opening of some Apple Internet services may require both parties to sign a separate service agreement. The separate service agreement may be displayed in the form of electronic documents or independent paper documents. You can decide whether to accept the service agreement and open the service according to your own situation.
3.1.3 You need to complete the payment in time after the order is submitted. Some services may have time limit, inventory limit or activity quantity limit. After the order is submitted, if you fail to pay in time, or the quantity is insufficient or has reached the limit during the payment period, you may not be able to use the relevant services.
3.1.4 Due to various reasons such as marketing activities and product promotion, Apple Internet may launch "limited time free", "limited time offer", "limited amount offer", "recharge offer" and free service and other preferential measures (hereinafter collectively referred to as "preferential measures") in a specific period. You understand and agree that these preferential measures may be temporary, phased or limited in quantity, or may only apply to customers who meet specific conditions, You need to purchase and use the corresponding services according to the corresponding rules. Unless otherwise expressly stated in writing, preferential measures may not be applied simultaneously.
3.2 Service fee
3.2.1 The settlement methods of Apple Internet services may be divided into prepaid and postpaid. To ensure the timely opening or continuous provision of services, you should abide by this agreement and the service rules of the services you use and pay the fees in a timely manner. After some Apple Internet services are opened (such as ECS, cloud database, etc.), even though you have not added new service items or resources, nor have you conducted new operations, because these services will continue to occupy resources, there will be continued deductions, and you should renew or close the service in a timely manner.
3.2.2 Preferential measures are set based on specific conditions, such as those for products with specific configurations, those for which you need to use a specific period or quantity of products at one time (such as annual package discount). If you finally do not meet specific conditions, you will not be able to enjoy corresponding discounts (including but not limited to discounts, coupon gifts, preferential use of other services, etc.), Both parties shall settle the fees according to the original price of the official website of the corresponding service at the time of purchase.
3.2.3 You can make online payment or recharge and renew your account, or pay fees to Apple Internet through bank transfer (to ensure the continuity of the service, if you choose to pay fees offline, you should reserve a reasonable time for Apple Internet to verify the payment and complete your account recharge).
3.2.4 For services settled by natural month, after Apple Internet provides you with the payment bill of the previous month, you must check and confirm or raise an objection within 5 working days. If Apple Internet does not receive your confirmation or objection within 5 working days, it is deemed that you have no objection; If you have any objection, both parties shall settle it through friendly negotiation. If the negotiation fails, the data of Apple Internet system shall prevail. Apple Internet will issue an invoice based on the amount finally confirmed by both parties. You should pay within 10 working days after receiving the invoice from Apple Internet. Unless the service rules corresponding to the service you use are inconsistent with this article or otherwise agreed by both parties.
3.2.5 In case of sales discounts, sales returns or other situations where red ink invoices need to be issued or re issued in accordance with national regulations for the business under this agreement, Apple Interconnect shall issue red ink invoices or re issue invoices to you in accordance with national tax regulations, and you shall return the invoices issued by Apple Interconnect in accordance with national tax regulations or submit to the tax bureau the valid certificate of red ink special invoices required to be issued by Apple Interconnect. Both parties agree to implement the following policies:
(1) If the refund occurred in the month when the invoice was issued and you have not yet made tax certification deduction, you can return the invoice.
(2) If you have deducted the tax certification of the invoice, or the refund time has exceeded the month when the invoice was issued, you should provide Apple Internet with the necessary materials for issuing red ink invoices, such as the Information Form for Issuing Red Ink VAT Special Invoices.
(3) For refund applications that have not been invoiced or have been invoiced but have not been delivered to you, you do not need to provide invoice related information. If the above conditions cannot be met, you will not be able to refund, and the consequences will be borne by you. Apple Internet will not bear any responsibility for this. After completing the above refund and red ink invoice issuance process, Apple Internet will issue a new invoice according to your actual consumption amount within the next month, and refund the remaining cash in your account.
3.3 Service support
3.3.1 Apple Internet will provide you with after-sales services to help you answer and deal with problems encountered in using Apple Internet services.
3.3.2 Apple Interconnect will take basic security protection measures for its systems and equipment in accordance with laws and regulations. If your requirements for security protection measures are higher than the above basic security protection measures, you have the right to purchase higher security protection services or configure other security protection software and systems according to your own needs.
3.3.3 You shall take necessary and effective security measures for the computer information system and equipment you use. If your rights and interests are damaged due to your failure to take the above measures, you shall be responsible for it.
3.3.4 Apple Interconnect provides availability assurance within the service rules. If your requirements for availability are higher than the service rules, you need to take the initiative to set your own system for high availability. Apple Interconnect can provide necessary assistance. If Apple Internet is required to cooperate in the design, both parties shall negotiate and confirm separately.
3.4 Suspension or Termination of Services
3.4.1 In order to provide you with more perfect services, Apple Interconnect has the right to regularly or irregularly overhaul, maintain, upgrade and optimize the service platform or related equipment, systems, software, etc. (collectively referred to as "routine maintenance"). If Apple Interconnect's services are interrupted or suspended within a reasonable time due to routine maintenance, Apple Interconnect does not have to bear any responsibility to you. However, Apple Internet shall notify you of routine maintenance at least 24 hours in advance. If the non routine maintenance is caused by force majeure, fault of the basic operator and other reasons, Apple Interconnect shall notify you in a timely manner.
3.4.2 In order to ensure the security and stability of the service, Apple Interconnect may make major adjustments such as machine room migration and equipment replacement. The foregoing may cause Apple Interconnect's service to be interrupted or suspended within a reasonable time. Apple Interconnect does not need to be responsible for this. However, Apple Interconnect shall notify you 30 days in advance and you shall cooperate; If you do not cooperate in the adjustment, or Apple Internet cannot contact you, the consequences arising therefrom shall be borne by you.
3.4.3 If the specific service you purchased contains storage function, after the expiration or termination of the service, Apple Interconnect will retain any information such as the data you stored in the service for a corresponding period according to the service rules of the service. You should bear the expenses incurred during the retention period (if any), settle the expenses on time and complete the migration of all data. After the retention period expires, your aforementioned information will be deleted.
3.4.4 Apple Internet has the right to adjust and terminate some or all of the services (including but not limited to offline, iteration, integration, etc.) at any time according to its own operational arrangements. However, Apple Interconnect shall notify you at least 30 days in advance so that you can do a good job in the transfer and backup of relevant data and business adjustment to protect your legitimate rights and interests.
3.5 Based on the timeliness, complexity, efficiency and other characteristics of network services, as well as regulatory requirements, policy adjustments and other reasons, you agree that Apple Internet can adjust this Agreement and the relevant service rules of Apple Internet from time to time, and publish them through one or more of the website announcements, email notifications, SMS notifications, system messages, and in station messages; If you continue to use Apple Internet Services after adjustment, it means that you have fully read, understood and accepted the revised content, and will also follow the revised content.
3.6 If you choose to use services outside mainland China, you should ensure that you meet the requirements of laws, regulations and policies in mainland China, as well as that your qualifications, capabilities and use behavior meet the requirements of local laws, regulations and policies.
3.7 Third party products or services
3.7.1 If you obtain and use any product or service provided by a third party through the Apple Internet platform (including but not limited to the product or service provided by a third party such as a service provider in the Apple Internet service market), you should evaluate whether the product or service meets your requirements.
3.7.2 The opening of third-party products or services may require you to sign a separate agreement with the third party. The separate agreement may be displayed in the form of electronic documents or independent paper documents. You can decide whether to accept the agreement and use the products or services according to your own conditions.
3.7.3 Any dispute arising from your use of third-party products or services shall be resolved by you and the third party.
Article 4 Rights and Obligations of Customers
4.1 You have the right to use Apple Internet services and obtain technical support and after-sales services from Apple Internet in accordance with this agreement.
4.2 When using the services on the Apple Internet platform, you must comply with relevant laws, regulations and service rules, and ensure that you have the business qualifications and capabilities required by laws and regulations. You must not perform, including but not limited to, the following acts, nor provide convenience for any acts in violation of laws and regulations:
4.2.1 Opposing the basic principles stipulated in the Constitution.
4.2.2 Those that endanger national security, divulge state secrets, subvert state power and undermine national unity.
4.2.3 Damage to national honor and interests.
4.2.4 Inciting national hatred and discrimination and undermining national unity.
4.2.5 Those who undermine the national religious policy and promote heresy and feudal superstition.
4.2.6 Spreading rumors, disturbing social order and undermining social stability.
4.2.7 Spreading obscenity, pornography, gambling, violence, murder, terror or abetting crime.
4.2.8 Insult or slander others and infringe upon their legitimate rights and interests.
4.2.9 Carry out any behavior violating the "seven bottom lines".
4.2.10 Other contents prohibited by laws and administrative regulations.
4.3 When using the services on the Apple Internet platform, you must maintain the order and security of the Internet, not infringe the legitimate rights and interests of any subject, and not conduct, including but not limited to, the following acts, nor provide convenience for them:
4.3.1 Commit fraud, hypocrisy or misleading acts, or commit acts that infringe upon the intellectual property rights of others and other legitimate rights and interests, such as "private service", "plug-in", etc.
4.3.2 Publish and disseminate spam (SPAM) or contain illegal information that endangers national order and security, feudal superstition, obscenity, pornography, vulgarity, etc.
4.3.3 Violate the operation regulations of the network, equipment or service connected with Apple Internet; Illegal or unauthorized access, misappropriation, interference or monitoring.
4.3.4 Carry out any acts that undermine or attempt to undermine network security, including but not limited to malicious scanning, illegal intrusion into systems, illegal access to data, etc. on websites and servers by means of viruses, trojans, malicious code, phishing, etc.
4.3.5 Implement any change or attempt to change the system configuration provided by Apple Internet Services or damage the system security; Use technology or other means to disrupt or disrupt the operation of Apple Internet Services or the use of Apple Internet Services by others; In any way, it interferes with or attempts to interfere with the normal operation of any product or any part or function of Apple Internet, or the production, release and dissemination of the above tools and methods.
4.3.6 You are frequently attacked (including but not limited to DDoS attacks) due to your engagement in any business, including but not limited to "DNS resolution", "security services", "domain name proxy", "reverse proxy", etc., and do not correct your behavior in time, or do not eliminate the impact according to Apple Internet requirements, thereby affecting Apple Internet service platform or others.
4.3.7 Carry out other acts that undermine the order and security of the Internet.
4.4 You shall pay the fees in full and on time according to the service rules. If you fail to pay the fees in time and in full, Apple Internet has the right to refuse to open the service or suspend or terminate the service without further notice, and can take one or more of the following measures:
4.4.1 In addition to paying the fees payable according to the agreement, you are required to pay Apple Internet liquidated damages at the rate of 1 ‰ of the owed fees for each day overdue until all the fees have been paid.
4.4.2 If your payment is overdue for more than 15 days, Apple Internet has the right to take measures at any time without further notice, including but not limited to unilateral termination of the agreement in advance.
4.4.3 If you pay late but you use prepaid services or your account has unused cash balance, Apple Internet has the right to directly use the prepaid fees and cash balance to offset the arrears and liquidated damages without further notice to you.
4.4.4 Delete some or all of the information and data you stored or generated based on the use of Apple Internet Services.
Article 5 Apple Internet Rights and Obligations
5.1 Apple Internet shall provide you with Apple Internet services and after-sales support in accordance with this Agreement.
5.2 Apple Internet only provides operation and maintenance for the Apple Internet service itself. You should ensure the security and stability of your network and equipment. If the following situations occur, you should solve them in a timely manner and avoid affecting the Apple Internet service:
5.2.1 Your internal network has problems, including but not limited to overload.
5.2.2 Your own equipment or the third-party equipment you use fails.
5.2.3 You can disconnect the device by yourself or cause network interruption by other means.
5.2.4 Any fault, network interruption, etc. caused by your own reasons.
5.3 If Apple Internet discovers on its own or based on information from relevant departments or complaints from obligees that you may violate relevant laws and regulations or this Agreement, Apple Internet has the right to make independent judgments based on the understanding of ordinary people and unilaterally take one or more of the following measures at any time:
5.3.1 You are required to delete and modify relevant contents immediately.
5.3.2 Restrict or suspend the provision of all or part of Apple Internet services to you (including but not limited to directly offline some of your services and withdraw relevant resources, and take action restrictions/account freezes on your account).
5.3.3 Terminate the provision of Apple Internet services to you and terminate the agreement (including but not limited to directly offline all your services and recover relevant resources).
5.3.4 If Apple Internet terminates the provision of services to you or the agreement according to this agreement, the fees you prepaid will be returned to Apple Internet as liquidated damages.
5.3.5 Investigate your other responsibilities according to law.
If Apple Internet takes corresponding measures (including but not limited to suspension of services, deduction of fees, termination of the agreement, etc.) in accordance with this agreement, it will not be deemed as a breach of contract by Apple Internet. If any loss is caused to you (including but not limited to business suspension, data clearing, etc.), you shall bear it yourself. The responsibilities and consequences arising from your violation of this agreement shall be borne by you. If you cause losses to Apple Internet or a third party, you shall compensate.
5.4 In order to reasonably protect the interests of you, your users, obligees and other parties, Apple Internet has the right to formulate a special infringement and complaint process system, and you should comply with it. If Apple Interconnect receives a complaint or report from a third party against you, Apple Interconnect has the right to disclose your relevant information (such as your subject information and all the information you submitted on the complaint or report, such as the counter notice and relevant evidence) to the third party, and require you to negotiate with the complainant (including but not limited to establishing a three party email group that includes you, Apple Interconnect and the complainant for you and the complainant to communicate directly and provide evidence to each other, the same below), If you complain or report other Apple Internet customers, Apple Internet also has the right to disclose your relevant information (such as your subject information and all the information you submitted about the complaint or report, such as the notice and relevant evidence) to the respondent, and require you to negotiate with the respondent in order to resolve the complaint and dispute in a timely manner and protect the legitimate rights and interests of all parties. You should cooperate, otherwise, your continued use of Apple Internet services may be affected, If any loss is caused to you or the other party, you shall bear it.
5.5 Apple Internet may transfer part or all of the rights and obligations under this Agreement to a third party, but Apple Internet must notify you in writing 90 days in advance. Both parties agree to sign all reasonable and necessary documents and take reasonable and necessary measures for the effectiveness of this clause.
5.6 You agree that Apple Internet has the right to use your name, brand, trademark logo, etc. as a business case for publicity and display.
Article 6 Customer Data
6.1 You guarantee that you will not and have never infringed the legal rights of any individual or entity with respect to the data that you have collected, obtained or generated for you in accordance with the law by storing, uploading to the Apple Internet Service, or using the Apple Internet Service to analyze, distribute or otherwise process.
6.2 You guarantee that you have the right to use Apple Internet Services to store, upload, analyze and distribute the above data, and that the above processing activities comply with the requirements of relevant laws and regulations. There is no violation of law, tort or contract agreement with a third party, and the data will not be used for illegal purposes.
6.3 You have the right to use Apple Internet Services to upload, analyze, delete, change and other processing of data (the specific service rules of the service you use shall prevail). With regard to the processing of data deletion, change and other processing, you should operate cautiously and bear the consequences arising from such operations.
6.4 Except as required by your use of Apple Internet services and as otherwise stipulated by laws and regulations, Apple Internet will not contact or use your data without your consent.
6.5 You should back up the data according to your own needs. Apple Internet only provides data backup services according to relevant laws and regulations or service rules, and Apple Internet only takes responsibility within the scope of data backup services provided by law or agreement.
6.6 You shall bear all the consequences and liabilities arising from the violation of laws and regulations in the production, collection, processing, use and other related matters of your data, and Apple Internet has the right to terminate the provision of Apple Internet services to you in whole or in part at any time. You shall bear all losses or liabilities and expenses incurred thereby.
Article 7 Intellectual Property Rights
7.1 The trademark right, copyright or other intellectual property rights enjoyed by both parties shall remain solely owned by each party, and will not be transferred to the other party or shared by both parties because of the signing or performance of this agreement.
7.2 Either party shall respect the intellectual property rights of the other party and the third party. If any third party brings a lawsuit or claims against the other party for the reason that one party infringes its intellectual property rights and other legitimate rights and interests, the responsible party shall independently handle relevant disputes, compensate the other party for its direct economic losses, and exempt the other party from liability.
Article 8 Confidential Information
8.1 Both parties have provided or will disclose certain confidential information for the purpose of this agreement. Among them, the party disclosing confidential information is the "disclosing party", while the party receiving confidential information is the "receiving party".
